Tenor
AK 4/24
21.2.2024
AK 4/24

Section 7 (1) nos. 3, 5 and 9, section 8 (1) no. 3, section 8 (6) no. 2 and section 9 (1) of the Code of Crimes against International Law (Völkerstrafgesetzbuch – VStGB)

General functional immunity of public officials does not apply in the case of crimes against international law, regardless of the status and rank of the perpetrator. The fact that foreign
officials are excluded from this functional immunity if they commit crimes against international law is an indisputable part of customary international law.

In order for conduct to qualify as the crime against humanity of enslavement under section 7 (1) no. 3 of the Code of Crimes against International Law, it is not absolutely necessary for the perpetrator to have exercised an arrogated ‘right of ownership’ over the victim for a longer period of time; this is merely one indicator of enslavement and does not mean that the possibility of enslavement is excluded in short-term cases.

3 StR 246/22
9.3.2023
3 StR 246/22In response to the appeal on points of law (Revision) lodged by the Federal Public Prosecutor General, the judgment handed down by Munich Higher Regional Court on 25 October 2021 is set aside insofar as it concerns the individual penalty imposed for the crime against humanity of enslavement resulting in death (and for other criminal offences arising from the same conduct) and insofar as it concerns the aggregate sentence; the associated factual findings, however, are upheld in each case.

To the extent that the judgment is set aside, the case is remitted to a different criminal division of the Higher Regional Court for a new hearing and decision, including in relation to the costs of the appeal.
